Hey Everyone, I am writing you today to discuss the illegal and immoral system of segregation they have instituted under the guise of public good. I believe in vaccinations and therefore I am not against vaccines. Ultimately this boils down to choice, the expression of Democracy Manifest and the system we have built our society upon. This consensus of consciousness gives each of us individual rights and choice. This system is state enforced segregation that seems to try to undue the good work we have done to unite the populace over this last year because of fear. Throughout this passport system we are seeing violations of our own laws in order to protect the public good. The only caveat is if its in the interests of public good, given that the Delta variant is transmissible by vaccinated and unvaccinated alike this system fails to protect us and there go, violates the rights and freedoms we have built our nations upon. Each place that removed the mask mandates saw a jump in cases and now that everyone is again wearing masks the cases are dropping. Vaccines only temper the immune system against the pathogen and do not completely reduce the risk of transmission, we have known this for a century. Therefore masks with vaccines will see us through this adversity, not segregating our people into groups with different rights. This was wrong throughout our history and its still wrong today. Therefore, as follows is a list of the statues that are being violated by this vaccine passport system: Canada: (Charter of Rights and Freedoms) Section 1 - The Charter protects those basic rights and freedoms of all Canadians that are considered essential to preserving Canada as a free and democratic country. It applies to all governments – federal, provincial and territorial – and includes protection of the following:
fundamental freedoms, democratic rights
the right to live and seek employment anywhere in Canada
legal rights (life, liberty and personal security)
equality rights for all
the official languages of Canada
minority language education rights
Canada's multicultural heritage
Indigenous peoples’ rights
This clause indicates that security of the person and the right to live and seek employment anywhere in Canada. This therefore is violated by the vaccine passport system as freedom of mobility is infringed upon. Furthermore, this also violates equality rights as it creates a second class system for unvaccinated individuals. Section 2 - Everyone has the following fundamental freedoms: freedom of conscience and religion;
Section 3 - Democratic rights of citizens - This allows everyone the ability to hold public office. Given that there is a mandate proposed for mandatory vaccines for public workers this statue would also be violated. Section 6 - (1) Every citizen of Canada has the right to enter, remain in and leave Canada. This clause is infringed upon by this vaccine passport system as it prohibits freedom of mobility as defined by section 6 of the Canadian Charter. Section 7 - Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice. This statue states that everyone has the right to security of the person which includes medical care. This has been violated as many unvaccinated people are being turned away from doctors and hospitals. This is also in violation of the Medical ethics standards as well as a clear violation of the Hippocratic oath. Section 12. Everyone has the right not to be subjected to any cruel and unusual treatment or punishment. Segregation as we know has nearly decimated our people through history. Times where our inhumanity overtook our humanity. These instances where people were separated into different groups with different rights was wrong then and its especially wrong now given how bloody our history became in order to stop it. We waged an entire civil rights movement, waged a world war and waged many marches to show history how wrong it was. Therefore any application of segregation is cruel and unusual punishment. Section 15 - (1) Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability. Given that many are worried about the vaccines for religious reasons, having them segregated for their religious or political beliefs is illegal and immoral; and violates section 15 of the Canadian Charter. Federal Labor Standards - These standards protect against discriminatory dismissals from employment. Given that we are protected against discrimination based on medical conditions, political views and religious views, each company that dismisses an unvaccinated employee is guilty of discrimination. Furthermore, any government that allows such discrimination given that this system fails to protect us, is also guilty of discrimination. There are many ways for employers to assist unvaccinated employees including, remote working, mask use for all employees as well as vaccine outreach programs. However, dismissing someone simply for being unvaccinated is illegal and dismantles the ideals that we built our nations upon. I will now review the United States Provisions that are being violated by this passport system: The Bill of Rights - This document also guarantees freedom of mobility, religious and political rights as well as the security of the person clause that guarantees equality of healthcare. The American Medical Association Ethics Standards - These guarantee that every person receives medical care. This also ensures that patient rights are upheld and given that doctors are refusing treatment to unvaccinated people this is a clear violation of their ethics standards. The Civil Rights Act of 1964 - This provisions allows people to be protected against discrimination based on their religion as well as employment discrimination. Given that people are loosing jobs due to this passport system we are violating all the rights we founded our nations upon and even infringing on international law. You cannot sacrifice the fundamental tenants of your societies in defense of them, each time you do you lose a piece of your morality. International - The Universal Declaration of Human Rights - This document was ratified by the international community and this is the standards of rights that everyone agreed to: Section 2 - Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty. Section 3 - Everyone has the right to life, liberty and the security of person. Section 5 - No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. Section 7 - All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination. Section 13 - 1. Everyone has the right to freedom of movement and residence within the borders of each State. 2. Everyone has the right to leave any country, including his own, and to return to his country. Section 18 - Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance. Section 20 - 1. Everyone has the right to freedom of peaceful assembly and association. 2. No one may be compelled to belong to an association. Section 21 - 1. Everyone has the right to take part in the government of his country, directly or through freely chosen representatives. 2. Everyone has the right to equal access to public service in his country. 3. The will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures. Given that we know this system doesn't fully protect the population, this system of segregation is a grave overreach of government. All this system does is cater to peoples fears and makes unvaccinated people the target of those fears. I see biased news reports that seek to create fear against unvaccinated individuals and every news reporter that continues this fear mongering will have blood on their hands. I also see news report after report about new discriminatory actions taken against unvaccinated people. They are loosing jobs, businesses, being denied medical care, paying more for goods and services, having their mobility infringed upon and are prohibited from certain shops and activities. This same treatment harkens back to the civil rights movement and the atrocities committed against people of color. We nearly split a great nation apart to stop this atrocity and have seemingly forgotten the cost. Furthermore, when tyranny rose in Europe we waged an entire world war to stop the Jewish genocide and the holocaust. This lesson has been paid in the blood of our ancestors, segregation is wrong and it always has been. It was wrong during the Civil Rights movement, Apartheid, The Japanese internments and the holocaust, and its wrong today. We cannot make unjust or illegal reductions on the rights of people within our nation. The rights of the individual are what make the collective, without individual contributions and ideas we will never evolve as a people or a society. We must uphold the rights our ancestors bled and died for or else we dishonor their memories and our nation each time. We have come far over the last year through this pandemic and we have united the world like never before. There is more compassion, cooperation and conscience now than we have seen for decades. Many are afraid of this unity and seek to instigate us and turn us against one another but we cannot let them. We must stay resolute in our convictions to uphold the standards of human rights and human dignity or else we will be overshadowed by our own inhumanity.
